Definition of "Amusement Machine" Amended to Include Other Amusement Devices.

An ordinance has been established that amends the definition of amusement machine for the purposes of clarifying that amusement machine means any mechanical or electronic device operated or intended to be operated for the purposes of amusement or skill where the use or operation of which is conditioned upon payment of a fee either by insertion of a coin, token or similar object in a slot, or otherwise.

Taxicab Review Board Created.

A resolution has been passed that creates a 7-member Review Board which is directed to study issues of taxicab charges, fares and regulation including vehicle and driver standards. The review board is further directed to make written recommendations related to specific actions and policies that can be taken or adopted to improve the provision of taxicab services in the City of Milwaukee.

Installation of Cameras Required in Taverns When 3 or More Crimes Occur in One Year.

An ordinance has been established permitting the police chief to order the installation of security cameras in any licensed alcohol beverage retail establishment where 3 or more criminal incidents have occurred in a one-year period.  The ordinance also requires security cameras that are installed to provide a clear image of the entire premises, and for on-duty store employes to provide a copy of recorded digital security camera images to law enforcement officers immediately upon request. This ordinance shall be null and void a year from the October 3, 2008, effective date.

Sale of Alcohol Not Restricted to Single-Service Cups on Certain Extended Premises.

An ordinance has been established permitting the sale of alcohol beverages in single-service bottles and cans on temporary extensions of alcohol beverage premises when permitted by the Chief of Police upon application of a licensee or a sponsor of the special event.

License Holders Liable for Enforcement Costs for Chronic Nuisance Violations.

An ordinance has been established extending liability for police enforcement costs for nuisance activity to any individuals or entities licensed in the operation of a business upon a premises (as opposed to just the premises owner), and amending the definition of nuisance activity to include violations of possession or use of firearms, underage alcohol activities and adults contributing, allowing or providing alcohol to underage persons.

License Disqualification Periods and Change of Circumstance Proceedings Standardized.

An ordinance has been established to clarify and make consistent the regulations and procedures related to disqualification and change of circumstances whenever an application is denied, or license is not renewed, is revoked or is surrendered. The ordinance established that no hearing related to changed circumstances shall be held by the Licensing Committee within a period of 12 months following the date of denial, nonrenewal or revocation of a license for a reason relating to the fitness of the location of the premises, and that not more than one such hearing involving the same party at the same premises shall be held by the licensing committee during the period of disqualification.

The ordinance also established that the fee to file for a hearing related to changed circumstances shall be $75.

Taxicab Meter Fare Rate for First 1/8th Mile, Waiting Time Increased.

An ordinance has been established which provides an increase in the maximum charge for the first 1/8th mile from $2.25 to $3.50. This increase shall be effective until January 1, 2009, at which time the maximum charge will be reduced to $2.25 for the first 1/8th mile. The ordinance further provides an increase in waiting time from $0.25 per minute to $0.40 per minute. The increase in the rate for waiting time will also be reduced back to $0.25 per minute on January 1, 2009.

Renewal of Alcohol Beverage Retail Establishment Licenses at Certain Premises Restricted.

An ordinance has been established that provides if any person fails to have issued by the city clerk prior to the expiration of the license an alcohol beverage retail establishment license that has been approved by the Common Council, the person shall not be permitted to apply for and be issued more than one renewal license for the premises, provided that the person is residentially and in all other respects qualified to make the application. In addition, the ordinance establishes that the Common Council may waive this requirement if unusual circumstances have been demonstrated.

Objections to Renewal of Certain Licenses Must Be Filed 45 Days Before License Expires.

An ordinance has been established which changes from 30 to 45 the number of days prior to the date of license expiration written objections to the renewal of the following licenses are required to filed with the City Clerk: all alcohol beverage retail and wholesale establishment licenses, manager and operator licenses, all tavern entertainment licenses, and center for the visual and performing arts licenses.

An ordinance has been established to clarify and make consistent the procedures of the Licensing Committees and the Common Council in matters involving license and permit applications, renewals, non-renewals, suspensions and revocations.

Class “B” Tavern License Holders Allowed to Exercise an Age Restriction.

An ordinance has been established which allows Class “B” tavern license holders, in the interest of the public good and keeping the general peace, to exercise a predetermined age restriction which must be posted at the establishment. The age restriction must also be included in the plan of operation and may not be changed during the license period.

Standards Established for the Issuance of Warning Letters to Direct Seller License Applicants.

An ordinance has been established which provides standards for the issuance of warning letters to applicants for direct seller licenses and revises certain regulations for the purposes of clarifying language and eliminating obsolete provisions.  The standards for the issuance of warning letters have been established for the purposes of reducing the number of direct seller license applications required to be scheduled before the Licenses Committee for hearings on whether the applications should be recommended for approval or denial to the Common Council.

Uniform Testing Procedures related to Knowledge of City Geography and Public Passenger Vehicle Regulations Established

 
 

An ordinance has been established which provides that applicants for public passenger vehicle (PPV) drivers' licenses for the operation of handicapped and elderly vehicles be required to take the same city geography and PPV regulation tests currently established by the City Clerk and administered by the Milwaukee Police Department-Safety Division for all other PPV driver license applicants.

Newspaper Vending Box Permit Regulations Amended, Permit Fees Increased

 
 

An ordinance has been established which amends regulations related to newspaper vending boxes, including a provision requiring that a permit be displayed on the newspaper vending box with the designated location indicated on the permit.  In addition, the ordinance changes the license peiod and permit fee from a biennial permit with a fee of $35 to an annual permit with a fee of $50.

Parking Prohibited on City Streets for Vehicles related to Collecting and Storing of Junk, Violators to be Towed

 

An ordinance has been established which prohibits parking or standing of any vehicle containing collected junk or in which junk is stored upon any highway of the city except while engaged in the process of loading or unloading. Vehicles found in violation may be towed, and a reclamation and storage charge may be imposed.

Certain Signage Required to be Displayed on Junk Collector and Junk Dealer Vehicles

 
 

A ordinance has been established which provides that motor vehicle used by junk dealers or junk collectors are required to have identifying signs placed on both sides of the vehicle, which display with lettering at least 3 inches high the name of the business or person operating the vehicle, a valid phone number, and the city of Milwaukee junk license number.

An ordinance has been established which eliminates language that implies an exemption from occupancy capacity requirements and penalties for certain Class "B" licensed establishments that also operate with a food dealer's license.

Types of Entertainment Authorized Under Special Party Permits Expanded

 
 

An ordinance has been established which amends the types of entertainment authorized under a special party permit (formerly "special dancing permit") for persons holding a Class "B" tavern, Class "B" fermented malt beverage or Class "C" wine license. Special party permit holders are authorized to offer entertainment or exhibitions consisting of music, dancing, singing, floor shows and cabaret performances upon the licensed premises.

Certain Alcohol Beverage License Applicants for Summerfest Grounds Exempt from Appearing before Licenses Committee

 
 

An ordinance has been established which exempts applicants for all new alcohol beverage retail establishment licenses for premises upon the Henry W. Maier Festival Park grounds from having to automatically appear before the Licenses Committee, provided the applicants have been previously granted such licenses for premises upon the Henry W. Maier Festival Park grounds.

Residency Requirements Amended for Amusement Machine Premises and Phonograph Distributor Licenses

 
 

An ordinance has been established which replaces a state residence and a one-year county residency requirement with a 90-day state residency requirement for an applicant for an amusement machine premises license, and replaces the county one-year residency requirement with a state one-year residency requirement for corporate agents applying for a phonograph distributor license.

Certain Public Passenger Vehicle Permit Application Processes, Requirements and Hearing Procedures Established, Separate Penalty for Equipment Violations

 
 

An ordinance has been established which establishes certain permit application processes and requirements and hearing procedures related to the granting, denial, renewal, nonrenewal, suspension, revocation and surrender of public passenger vehicle permits, and clarifies provisions related to certain vehicle inspection procedures and the prohibiting of the operation for hire of public passenger vehicles not holding valid public passenger vehicle permits. In addition, the ordinance establishes a separate penalty where any person violating certain public passenger vehicle equipment regulations shall upon conviction be subject to a forfeiture of not less than $25 nor more than $200.

Occupancy Certificate Requirements Amended for Extended Hours Establishment Licenses

 
 

An ordinance has been established which allows the building owner or applicant to provide proof of application for an occupancy certificate in lieu of submitting a valid occupancy certificate when applying for an extended hours establishment license, but the license shall not be issued until proof of a valid occupancy certificate is provided.

Closing Hours for Class "B" Alcohol Beverage Establishments Amended for Daylight Saving Time

 
 

An ordinance has been established which amends from 2:30 a.m. to 3:30 a.m. on the Sunday that daylight saving time begins the closing hours for premises holding Class "B" Alcohol Beverage Retail Establishment licenses.

Permanent $.50 Taxicab Meter Rate Increase Established, Temporary $1 Increase Repealed

 
 

An ordinance has been established which permanently increases the taxicab meter rate by $.50 from $1.75 to $2.25 for the first 1/8th of a mile. The temporary $1 taxicab meter rate increase, which was established May 26, 2006, and increased the meter rate from $1.75 to $2.75 for the first 1/8th of a mile, has been repealed.

Location of Certain Day Care Facilities Restricted within 300 Feet of Alcohol Beverage Establishments

 
 

An ordinance has been established which restricts any day care center from locating within 300 feet of a premises for which a Class "A" or Class "B" alcohol beverage establishment license has been granted and such license has not yet expired.  The requirements of this ordinance do not apply to a day care center in operation on the effective date of this ordinance.

Newspaper Vending Box Permit Regulations Amended

 
 

An ordinance has been established which amends regulations related to newspaper vending boxes, including permit application and grant procedures.  The ordinance provides for the removal of unlicensed boxes, and the holding of the boxes in a facility until reclaimed for a $35 per box fee. Unclaimed boxes shall be destroyed at regular intervals.  Provisions related to changes in license period and fee, and the requirement that a sticker be issued in association with a permit are not effective until 11/01/2007.

General Late Filing Fee Established, Increased for Applications related to Alcohol Beverage Establishment Licenses 

 
 

An ordinance has been established which increases the amount of additional fee required for the filing of a late renewal application related to a Class "A," "B," and "C"  alcohol beverage retail establishment license.  In addition, a late application fee of $25 has been established for any application filed after a deadline established by the City Clerk where no separate late filing fee has otherwise been established.

General Provisions Established related to Refund of Fees and Duplicate License Fee

 
 

An ordinance has been established which provides that if a permit or license application for a permit or license issued through the City Clerk's Office is withdrawn, or if such permit or license is denied or not issued, a certain amount of the permit or license fee is retained to defray the cost of application processing.  In addition, a fee of $8 has been established for a duplicate copy of any license or permit.

Fees Increased for Public Passenger Vehicle Replacement and Change of Agent

 
 

An ordinance has been established which increases from $35 to $50 the fee for each public passenger vehicle permit transfer related to vehicle replacement, and increases from $15 to $25 the fee for changing the agent or officer of a corporation holding a public passenger vehicle permit.

An ordinance has been established which provides that the fee for a temporary extension of alcohol beverage licensed premises for a special event shall be $35, if the application is filed at least 30 days prior to the event; and $50, if the application is filed less than 30 days prior to the event.

Graduated Penalty Established for Operating Unlicensed Public Passenger Vehicles

 
 

An ordinance has been established which provides that the penalty for persons convicted of operating unlicensed public passenger vehicles, or providing radio dispatch service to unlicensed public passenger vehicles, is a forfeiture of not less than $250 nor more than $1,000, depending upon the number of previous violations within a 24-month period.

An ordinance has been passed which clarifies that any person holding an alcohol beverage retail establishment license is required to surrender the license within 5 working days following the day on which the person ceases operations permitted by the license.

An ordinance has been passed which permits Class "B" and Class "C" licensed alcohol beverage establishments to sell wine in an opened original bottle, in a quantity not to exceed one bottle, for consumption both on and off the premises where sold under certain conditions.

An ordinance has been passed which increased the taxicab meter rate from $1.75 to $2.75 for the first 1/8th of a mile.  The meter rate increase is effective May 26, 2006, and automatically expires on and after November 26, 2006.

Amendment to Definition of Luxury Limousine 

 

An ordinance has been established which amends the definition of luxury limousine to mean a category of for-hire, unmetered, unmarked ground transportation vehicles regularly engaged in the business of carrying passengers on a prereserved basis only and which meets either a stretched limousine or executive sedan classification definition.  View List of Approved Vehicles for makes and models which have been approved to operate as luxury limousines under the executive sedan classification.
