--------------------RULE II-------------------- APPLICATIONS FOR ORIGINAL EXAMINATION RULE II, Section I FILING APPLICATIONS (1) No person shall be admitted to an original examination unless such person shall have prepared and filed an application for said examination upon the form furnished by the Department of Human Resources, which application shall not have been rejected by the Director of Human Resources for such cause in accordance with the provisions of these rules. (2) Applications for an original examination shall be received only during the period prescribed for filing applications in the public notice of said examination, which period shall be subsequent to the call thereof, provided, however, that in the case of examinations which the Department of Human Resources advertises as continuous examinations, applications may be filed at any time prior to the time of the examination. (3) The applicant shall be required to make application, either typewritten or in his own handwriting, and to certify that the statements made are true, complete, and correct; provided, however, that applications may be received from any person who is unable to write, filled out by another person other than the applicant, but certified to by him and signed with the mark of the applicant, duly witnessed. RULE II, Section 2 RESIDENCE (1) Applicants for examinations must be residents of the State of Wisconsin for a period of at least one year prior to making application for examination, and residents of Milwaukee County for a period at least thirty days immediately preceding examination, unless longer periods of residence in the county are prescribed; provided, however, that in examinations for classifications requiring technical, professional or scientific knowledge and experience, such residence requirement may be waived by the Director of Human Resources and the Director of Human Resources may waive the requirement for one year state residence for applicants to be licensed in the health care field. 2) All employees in the classified service shall maintain their domicile and principal place of residence within the geographic limits of Milwaukee County during their employment, except persons holding the following job titles who may maintain their domicile and principal place of residence in Racine, Kenosha, Walworth, Waukesha, Washington and Ozaukee Counties (3); Within the confines of the State of Wisconsin. (4) All classifications which require that the incumbent be registered or eligible for registration as a Nurse in the State of Wisconsin.

The Director of Human Resources shall annually review eligibility lists, classification, scientific, professional, technical, or skill requirements, response to recruitment, and qualifications of applicants and determine whether the residency requirement prevents or deters adequate staffing of qualified personnel. Classifications shall be added to or deleted from the exempt list in conformity with his/her findings. (4) Employees holding classifications removed from the exempt list and who have established and maintained domicile and principal residence in the counties of Racine, Kenosha, Walworth, Waukesha, Washington, or Ozaukee (6) or outside Milwaukee County (7) at the time the classification is removed from the exempt list shall not be required to establish and maintain domicile and principal residence within Milwaukee County. However, should employees who have established and maintained domicile and principal residence in the counties set forth above, 6 or outside Milwaukee County,7 remove such residence and establish and maintain domicile and principal residence in Milwaukee County, such employees shall not be again permitted to establish and maintain domicile and principal residence outside Milwaukee County. Employees holding classifications removed from the exempt list and who presently maintain domicile and principal residence within Milwaukee County shall not be permitted to establish and maintain domicile and principal residence outside Milwaukee County. (5) Employees who fail to comply with this rule shall be subject to Rule VII. RULE II, Section 3 AGE No applicant shall be permitted to complete an original or promotional examination who is less than eighteen years of age on the last day for filing applications for such examination; provided, however, that the Director of Human Resources may fix other age limits when deemed appropriate which shall be specified in the notice of examination for such classification. RULE II, Section 4 SEX Unless the call for any examination otherwise provides, applicants of either sex may be admitted to any examination, if, in other respects, they meet the preliminary requirements. RULE II, Section 5 HEALTH AND PHYSICAL ABILITY (1) Applicants may, at the discretion of the Director of Human Resources, be required to submit to a physical examination to be conducted by such physician or physicians as may be designated by the Director of Human Resources. (2) Such physician or physicians must submit a statement upon forms prescribed and furnished by the Director of Human Resources that the applicant has the physical ability to perform the duties of the position to which he seeks appointment. (3) The name of any applicant who fails to receive the endorsement of the physician or physicians as designated in (2) above, shall be withheld from certification and removed from the eligible register, and such applicant shall be viewed as having failed the examination. (4) Physical examinations, as prescribed in this section, shall be required when necessary to comply with Federal regulations, Wisconsin Statutes or Wisconsin Administrative Code relating to the classification or position to which the applicant seeks appointment. (5) Any person aggrieved by the action of the Director of Human Resources may appeal such action to the Civil Service Commission. RULE II, Section 6 SPECIAL QUALIFICATIONS In applications for examination for classifications which are scientific, professional and technical, or for classifications the duties of which require special qualifications, the Director of Human Resources may demand evidence of a satisfactory degree of education, training or experience, and may demand certificates of competency or the possession of such licenses as the law may provide as necessary for the practice of the profession, art or trade involved and may exclude applicants who fail to give such evidence or certificates or who do not possess such licenses. All such requirements or evidence of education, or licenses shall be prescribed in the public notice of the examination. RULE II, Section 7 DISQUALIFICATION (1) The Director of Human Resources may refuse to examine an applicant or after examination, to certify as eligible one who, (a) is found to lack any of the established preliminary (8) MINIMUM (9) requirements for the classification for which he applies, or; (b) cannot perform the requirements of the job with reasonable accommodations provided; or (c) has been guilty of a crime or of infamous or disgraceful or immoral conduct; or 8 (c) has been convicted of a violation of the law relevant to the classification for which he applies; or 9 (d) has been guilty of a dishonest or cruel act; or 8 (e)(d) has been dismissed for good cause from the public service; or (f)(e) has used or attempted to use any personal or political influence to further his eligibility or appointment; or (g) has intentionally made a false statement in any material fact; or 8 (h)(f) has practiced or attempted to practice any deception or fraud in his application, interview 9 or examination, or in securing his eligibility or appointment; or (I)(g) may be found to be deficient in personal qualifications requisite for the position for which he applies. (2) Any of the foregoing disqualifications shall be deemed sufficient cause to exclude such applicant from examination or to remove such person from any eligible list or from the county service after appointment; provided, however, that when the application of any applicant is rejected, or he/she has been declared by the Director of Human Resources to have failed in the examination, or his/her name is stricken or erased from any reinstatement or eligible or layoff/recall 9 list, for any of the causes enumerated in this rule, he may, by petition to be filed within ten days from issuance of notice of such action, make a written statement of the facts involved and ask for appropriate action by the Commission, and the Commission shall investigate the petition and enter in its minutes a finding thereon within thirty days. RULE II, Section 8 APPLICATIONS NOT TO BE RETURNED Applications, whether accepted or rejected, shall remain on file and shall not be returned. Minor defects or omissions in an application on file may be corrected or supplied only after special permission granted by the Director of Human Resources. The date and hour of receipt of applications shall be endorsed thereon. Applications of persons who fail to appear for examination shall not be used for any later examination, but shall be canceled. |
